Should I give a statement to police?
If you’ve been asked by police to give a statement in relation to your arrest or a forthcoming charge, you should always seek the advice of legal counsel. Your right to remain silent is guaranteed by Section 7 of the Charter of Rights and Freedoms and your right to retain and instruct counsel is guaranteed by Section 10(b).
Police are required to inform you of these rights upon arrest and you do not have to answer their questions. It is advisable to speak with legal counsel before making a statement or answering any questions. You need only provide the police with your correct name and address. Everything you say to the police is being recorded and can be used against you as evidence in court. This could be very detrimental to your case.
